Article 1 (Application of Terms and Conditions)
- Accommodation contracts and related contracts that this facility enters into with guests shall be subject to these Accommodation Terms and Conditions (hereinafter referred to as "these Terms and Conditions"). Any matters not provided for in these Terms and Conditions shall be governed by laws, regulations or generally established practices.
- If this facility enters into a special agreement to the extent that it does not violate laws, regulations, or customs, the special agreement shall take precedence over the provisions of the preceding paragraph.
Article 2 (Application for Accommodation Contract)
- Anyone who wishes to apply for an accommodation contract with this facility must provide this facility with the following particulars.
- Name of guest
- Date of stay and expected arrival time
- Accommodation fee
- Other matters deemed necessary by the facility
- If a guest requests to extend their stay beyond the date specified in paragraph 4 of the previous article, this facility will treat the request as if they had applied for a new accommodation contract at the time the request was made.
Article 3 (Establishment of Accommodation Contracts, etc.)
- An accommodation contract shall be deemed to have been established when this facility accepts the application stipulated in the preceding article. However, this shall not apply if this facility proves that it did not accept the application.
- When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, you will be required to pay the accommodation fee for the accommodation period as an application fee by the date specified by this facility.
- The application fee will first be applied to the accommodation fee finally payable by the Guest, and in the event of the occurrence of a situation to which the provisions of Articles 6 and 18 apply, it will be applied in the order of penalty charges and compensation, and the remainder, if any, will be refunded at the time of payment of the fee as provided for in Article 12.
- If the application fee stipulated in paragraph 2 is not paid by the date specified by this facility pursuant to the provisions of the same paragraph, the accommodation agreement will become void. However, this will only apply if this facility has so notified the guest when specifying the due date for payment of the application fee.
Article 4 (Special agreements not requiring payment of application fees)
- Notwithstanding the provisions of paragraph 2 of the previous article, this facility may enter into a special agreement stipulating that the application fee stipulated in the same paragraph shall not be required after the contract has been concluded.
- If, when accepting an application for an accommodation contract, this facility does not request the payment of the application fee pursuant to Paragraph 2 of the preceding Article or does not specify a due date for the payment of said application fee, it will be treated as if the special contract pursuant to the preceding paragraph has been accepted.
Article 5 (Refusal to enter into an accommodation contract and the facility's right to cancel the contract)
- This facility may not accept the conclusion of an accommodation contract and may similarly cancel the accommodation contract in the following cases.
- When the application for accommodation does not conform to these terms and conditions.
- When the Hotel is fully booked and no rooms are available.
- When a person seeking accommodation and a guest staying at the Hotel (hereinafter referred to as "guests, etc.") is deemed to be in danger of engaging in conduct that violates the provisions of the law, the public order, or good morals in relation to his/her accommodation, or when such conduct is deemed to have occurred.
- When a guest is drunk or behaves in a highly abnormal manner that causes a significant nuisance to other guests. (Article 5 of the Okinawa Prefecture Hotel and Inn Business Law Enforcement Ordinance)
- When a guest is deemed to be causing a nuisance to other guests due to his/her body or clothing being extremely unclean. (Article 5 of the Okinawa Prefecture Hotel and Inn Business Law Enforcement Ordinance)
- When the Guest can be clearly recognized as carrying an infectious disease.
- When the Guest, etc. is deemed to be an organized crime group as defined in Article 2, Paragraph 2 of the Law Concerning Prevention of Unjust Acts by Organized Crime Members (Law No. 77 of 1991), or an organized crime member, associate member or person related to an organized crime group or other anti-social forces as defined in Article 2, Paragraph 6 of the same law (hereinafter referred to as "anti-social forces, etc.").
- When the Guest is deemed to be a corporation or other organization whose business activities are controlled by anti-social forces.
- When the Guest is a corporate body whose officers are deemed to be members of anti-social forces.
- When a guest, etc., behaves in a manner that is disruptive to the accommodation or to other users, such as being noisy or causing danger or anxiety.
- When the guest does not comply with the prohibitions of smoking in guest rooms or non-smoking areas, or other provisions of the "Facility Usage Rules" established by this facility.
- When it is recognized that the guest is using the adult entertainment services provided by this facility, such as delivery health services.
- When an infectious disease is confirmed within the facility and it is determined that the risk of infection has increased.
- When a person has previously engaged in any of the acts described in this article at our facility.
- If a guest requests to extend their stay beyond the date specified in paragraph 4 of the previous article, this facility will treat the request as if they had applied for a new accommodation contract at the time the request was made.
Article 6 (Right of the Guest to Cancel Accommodation Contract)
- Guests may cancel their accommodation contract by notifying this facility.
- When a guest cancels an accommodation contract in whole or in part due to reasons attributable to the guest (excluding cases in which this facility has specified a due date for the application fee and requested payment pursuant to the provisions of Article 3, Paragraph 2, and the guest cancels the accommodation contract prior to payment), this facility will charge a penalty according to any of (1) to (3) listed below.
However, in cases where this facility has entered into a special agreement under Article 4, Paragraph 1, this will only apply if, in entering into such a special agreement, this facility has notified the guest of his/her obligation to pay a penalty when the guest cancels the accommodation contract.- 7 days before check-in date: 50% of the total accommodation fee
- 2 days before check-in date: 80% of the total accommodation fee
- The day before or no-show: 100% of the total accommodation fee
- However, termination of contracts for groups of more than 10 people must be agreed upon in advance.
- If a guest does not arrive by 8 p.m. on the day of their stay without contacting our facility (or two hours after the expected arrival time if the guest has stated it in advance), we may consider the accommodation contract to have been cancelled by the guest.
Article 7 (Accommodation Registration)
- On the day of the stay, guests will be required to register the following details at the reception location designated by this facility.
- Name, age, sex, address and occupation of the guest
- For foreigners, nationality, passport number, place of entry and date of entry
- Departure date and scheduled departure time
- Other matters deemed necessary by the facility
- If the Guest intends to pay the charges stipulated in Article 12 by traveller's cheques, accommodation vouchers, credit card or other means other than cash, these shall be presented in advance at the time of registration stipulated in the preceding paragraph.
Article 8 (Room Occupancy Hours)
- Guests may use the guest rooms of this facility from 3:00 PM to 10:00 AM the following morning. However, if the guests are staying consecutively, they may use the rooms all day, except on the days of arrival and departure.
- Notwithstanding the provisions of the preceding paragraph, this facility may accommodate guests using the rooms outside the hours specified in the same paragraph.In such cases, the following additional fees will be charged.
- Up to 3 hours overage will be charged at the room rate of 30%
- Up to 6 hours in excess, 50% equivalent to the room charge
- For over 6 hours, the room rate will be 100%
Article 9 (Observance of Terms of Use)
- Guests must abide by the "Facility Usage Rules" established by this facility and posted within the facility.
Article 10 (Business Hours)
- The opening hours of our facility are listed in the "Facility Usage Rules" posted within the facility.
- The hours set out in the preceding paragraph may be subject to temporary change due to unavoidable circumstances. In such cases, we will notify you by appropriate means.
Article 11 (Payment of Fees)
- Payment of accommodation fees, etc. payable by the Guest shall be made in Japanese currency or by other means such as credit card at the reception desk upon the Guest's arrival or when invoiced by the Hotel.
- Accommodation fees will be charged even if the guest voluntarily does not stay at the facility after the facility has provided the guest room to the guest and it is available for use.
Article 12 (Responsibilities of the Facility)
- This facility will compensate the guest for damages caused in the fulfillment or non-fulfillment of the accommodation contract and related agreements. However, this will not apply when the damages are not due to reasons attributable to this facility, such as natural disasters or malfunctions of social infrastructure.
- Our facility is covered by hotel liability insurance to deal with the unlikely event of a fire or other incident.
Article 13 (Handling when contracted rooms cannot be provided)
- When this facility is unable to provide a guest with a contracted room, it will, with the guest's consent, arrange accommodation of the same standards elsewhere where possible.
- Notwithstanding the provisions of the preceding paragraph, if this facility is unable to arrange other accommodations for the guest, it will pay the guest a compensation fee equivalent to the breach of contract charge, which will be applied to damages. However, if the inability to provide a room is due to reasons not attributable to this facility, the compensation fee will not be paid.
Article 14 (Handling of Deposited Items, etc.)
- Our facility does not accept cash or valuables at the front desk. Guests are asked to manage these themselves.
- In the event that damage such as loss or breakage occurs to items left by the guest at the reception area designated by this facility, this facility will compensate for such damage up to the amount of the accommodation fee that the guest is willing to pay, except in cases where this is due to force majeure. However, this facility may refuse to allow guests to bring expensive valuables and cash into the facility.
- This facility will not compensate for damage to any goods, cash or valuables that the guest brings into this facility and does not leave them at the reception area designated by this facility, except in cases where this facility is guilty of intentional or gross negligence.
Article 15 (Care of Guest's Baggage and Belongings)
- If a guest's baggage arrives at this facility prior to their stay, this facility will store it responsibly only if this has been approved in advance, and will hand it over to the guest when they check in at the reception location designated by this facility.
- If a guest's baggage or belongings are found left behind at the facility after checking out, and the owner is identified, the facility will contact the owner and ask for instructions. However, if there is no instruction from the owner or the owner is not identified, the facility will report the matter to the nearest police box within seven days, including the day the item was found. However, food, drink, tobacco, magazines, etc. will be disposed of on the same day.
- The facility's liability regarding the custody of guests' baggage and personal belongings in the cases of the previous two paragraphs shall be in accordance with the provisions of paragraph 2 of the previous article in the case of paragraph 1, and in accordance with the provisions of paragraph 3 of the same article in the case of the previous paragraph.
Article 16 (Parking Responsibility)
- When a guest uses the parking lot of this facility, regardless of whether the key to the vehicle is deposited with the guest, this facility is merely lending the space and is not responsible for the management of the vehicle. However, if damage is caused intentionally or negligently by this facility in the management of the parking lot, the guest will be liable for compensation.
Article 17 (Guest Responsibilities)
- If this facility suffers damage due to the guest's intentional or negligent acts, the guest will compensate this facility for the damage.
Article 18 (Permission to use photographs, etc.)
- Please be aware that we may retweet or otherwise use our official social media accounts (Instagram, Twitter, Facebook, TikTok, etc.) to post photos of our facility's users on social media.
Article 19 (Jurisdictional Court)
- Any doubts that arise between the Guest and the Hotel regarding any of the provisions of these Terms and Conditions shall be resolved through good faith negotiations. In the unlikely event that a dispute arises, the Tokyo District Court or the Tokyo Summary Court shall be the agreed court with jurisdiction.
Facility Terms of Use
In order to maintain the public nature and safety of the facility, guests using this facility must abide by the following rules in accordance with Article 9 of the Accommodation Contract. If you fail to abide by these rules, we will refuse to allow you to continue your stay in accordance with Article 5 of the Accommodation Contract.
About facility use
- Staff availability is from 9:00 to 18:00.
- Smoking is prohibited everywhere except in designated smoking areas.
If smoking (including electronic cigarettes) is found in the guest room, we will charge a special cleaning fee and a room damage compensation fee of 50,000 yen.
*For example, when a cigarette butt is found or the smell of cigarettes is detected by multiple employees. - Guests arriving by car should use the parking lot reserved for guests.
- Please do not leave valuables in the vehicle as we will not be responsible for any lost or stolen items.
- Please do not enter any areas of the facility other than our business premises without permission.
About the rooms
- Please be sure to lock the door during your stay.
- Please refrain from using any open flames (heating, cooking, candles, etc.) without permission, or any other actions that may cause a fire.
- We will not allow guests other than those registered as guests to stay at the hotel.
- Guest rooms must not be used for any purpose other than lodging.
- Please refrain from meeting visitors in your guest room.
- If minors are staying alone, consent from a parent or guardian is required.
- Please refrain from moving any fixtures or using them for purposes other than their intended use.
- If any buildings, furniture, fixtures, etc. are damaged, contaminated, or lost, you may be required to pay the actual cost of the damage.
- We do not provide room cleaning for guests staying multiple nights.
However, for hygienic reasons, guest rooms will be cleaned once every three days.
If the facility deems it necessary, it will clean the guest rooms at any time. - Please notify staff if any equipment becomes soiled due to vomiting, excrement, bleeding, dyed hair, etc.
If any dirt remains, you may be required to pay the actual cost of cleaning. - Please refrain from talking loudly or with the room door open.
- Please refrain from jumping or running around in the room.
- When you go out during your stay, please be sure to take your room key with you and make sure it is locked.
- Upon check-out, please leave your room key in the room when you leave.
- If you lose your room key, we will charge you 20,000 yen, including the cost of replacing the key and the cost of making a new key.
- We are unable to store valuables at the front desk, and there are no safes in the rooms.
Payment
- As a general rule, payment should be made at the front desk when you check in.
- Payment can only be made by cash, credit card or supported electronic payments.
- Any additional charges incurred during your stay may be charged at the time of your stay.
Regarding nuisance behavior
- Please refrain from bringing in or engaging in any of the following items within the facility that may cause inconvenience to other guests:
- Actions that cause disgust or inconvenience to others.
- Gambling and other acts contrary to public order and morals.
- Using photographs taken at this facility for commercial purposes without permission.
- Bringing in the following:
- Pets such as animals and birds (excluding assistance dogs)
- Gunpowder, volatile oil, and other flammable or explosive materials
- Something that emits a foul odor
- Guns, swords, stimulants, and other items that are prohibited from possession by law
- Items exceeding the reasonable amount
